REPRESENTATION BEFORE THE ORDINARY COURTS AND IN HUNGARIAN AND INTERNATIONAL ARBITRATION PROCEEDINGS

The Firm has an expanding litigation practice in various commercial, civil and administrative cases before Hungarian ordinary courts as well as before local and international permanent and ad hoc arbitration proceedings.

The Firm regularly acts as legal counsel for claimants or defendants in civil matters involving breaches of contract, indemnification for damages, pecuniary claims, competition, labour, copyright, patent, trademark infringement issues in litigation proceedings.

Among others, in a dispute for the finding of the invalidity of a privatization contract, our Firm successfully represented the winning Hungarian consortium.

The Firm represents leading Hungarian companies in complex patent and trademark infringement matters. The number of cases has increased in which we successfully represented our clients in connection with unfair competition matters. The Firm is representing one of the major coffee manufacturers in the so-called A "Coffee Cartel" case.

The Firm regularly represents clients in Hungarian and international arbitration proceedings.

In addition to the mandates where we have represented clients in litigation proceedings, Dr. Szecskay frequently receives invitations and appointments to act as an arbitrator with the Permanent Court of Arbitration attached to the Hungarian Chamber of Commerce and Industry, as well as the ad hoc arbitration panels supported by the Budapest Bar Association.

Nevertheless, the Firm promotes and is a strong proponent of dispute resolution by settlement. For example, our Firm has successfully mediated the settlement in a dispute between a chain store operator company owned by a foreigner entity and a Hungarian subsidiary of a multinational beverages company.

ADMINISTRATIVE PROCEDURES

The Firm has represented its clients in numerous administrative proceedings, for example, before the Office of Economic Competition, the Hungarian Energy Office, the State Supervision of Financial Organizations, the National Bank of Hungary and other such institutions in the course of supervisory control proceedings and consent or licence application proceedings.

CONSTITUTIONAL COURT PROCEDURES

The Firm has also prepared submissions and complaints filed with the Constitutional Court. Recently, the Firm prepared, on the behalf of the Hungarian Pharmaceutical Manufacturers Association, a submission which requested the constitutional interpretation of how an international obligation becomes effective under Hungarian law in connection with the introduction of product protection of pharmaceuticals.
